I.-1 20-2407 Approval by the Board of Education of a Charter School Facilities Agreement between and by District and Education for Change, Inc., a California non-profit public benefit corporation ("EFC") operating Achieve Academy (the nonprofit corporation and Achieve Academy are hereinafter collectively referred to as "CHARTER SCHOOL," for use of the facilities (formerly Hawthorne Elementary School) located at 1700 28th Avenue, Oakland, CA 94601, for a term of fifteen (15) consecutive fiscal years, commencing on July 1, 2021 and ending on June 30, 2036, subject to earlier termination as set forth in this Agreement ("Initial Term"), for annual rent as set forth in Section 3 of Agreement and Charter School Facilities Program Memorandum of Understanding between Education for Change on behalf of Achieve Academy, District, and the State of California on behalf of the State Allocation Board and California School Finance Authority, for Proposition 51 School Construction Grant, for the former, pursuant to terms and conditions thereof, with no direct cost to the District.
In 2017, we here at the PCSD partnered with OUSD's facilities department to identify opportunities and submit Proposition 51 applications for sites across the city. As a result of that partnership OUSD was awarded the opportunity to leverage $175 million dollars of State funding, $20 million of that for the Hawthorne site, to improve the facilities for ALL public school students in Oakland. This lease will allow EFC to access this important low-cost funding, and we strongly urge the board to adopt this facilities use agreement.

As UPA Principal and long time Fruitvale educator, I feel it is important that we provide a safe facility for the 650 Fruitvale students that attend Achieve Academy. Additionally, this long term lease would provide UPA the opportunity to increase enrollment and provide a quality OUSD education to more Fruitvale students. However, I am concerned about the potential that EFC may try to reopen Epic in the Fruitvale and thereby pull more Fruitvale students out of OUSD. Can EFC commit to not attempting to reopen Epic middle school?
Dear OUSD Board, please approve this lease so that the Achieve community can access critical state funds that are needed to provide for a safe and stable environment for students and staff. The repairs needed are just to be able to get the school up to minimum standards for earthquake safety and air quality. Achieve has been a community staple for years, and with your partnership, it can continue to be an important asset to the community for years to come.
Please approve this lease so that Achieve can make much-needed facilities improvements: repairs to the main building (roof, HVAC) and replacement of older portables and old modular building. This would make it safer for everyone onsite in the case of earthquake, fires/air quality, etc.
I work in the main building, which was built before 1918, and even things like the old central heating system breaking down and not being able to be repaired by technicians (requiring custom manufactured parts) can affect the learning environment of students.
Achieve Academy needs a long term lease so that we can provide our students with a stable and safe learning environment. We are currently operating our school out of an antiquated building without proper ventilation, heating or cooling and a modular building that was found to be seismically unsound. Granting us a long term lease will allow us to leverage prop 51 funds and make critical improvements to our campus. Our students, and all students, deserve to go to learn in a school that is safe and comfortable.

Achieve, formerly known as Hawthorne, is a historical landmark in Oakland's Fruitvale. As the Achieve community continues to support students, families, and the Fruitvale community, I ask that OUSD approves this long term lease so that Achieve can best serve its students and make changes that are necessary for the SAFETY of our students, and staff. I have taught at Achieve for almost 10 years, and can attest that our school is in dire needs of facility improvements in order to keep serving our community. This includes a new HVAC system for the whole school, a new roof, and replacement of the older modular buildings and portables. With multiple teachers, teaching in a seismically unsafe building (including myself), I am asking that OUSD support our long term lease, and allow Achieve to make the necessary changes to our school that our school, staff, and amazing students need and deserve.
Achieve has proved itself to be a school where students thrive academically and social-emotionally. Achieve Academy has been serving the community well since 2005. I have taught on campus since 2000 (starting at Hawthorne) and Achieve has kept partnerships with EBAC and La Clinica de La Raza while bringing a stronger academic culture to the school. A long term lease would allow us to make long term plans and continue to be a solid member of the community for many years to come.

First, an appreciation for the current Charter School Office at OUSD and OUSD legal counsel for working with the Achieve community to move this agreement forward. Achieve Academy is committed to providing the Hawthorne community a quality full service community school. However, the facility was built over 70 years ago, and the main building requires roof replacement AND has no HVAC system (particularly challenging at this time with COVID) and a modular building with significant seismic issues. We were granted up to $21.8 million to replace the older portables and rebuild the two-story modular and to do critical repairs in the main building. All of the intended repairs are safety repairs that ensure children at Achieve have a functioning HVAC system, a roof that won't collapse or leak and classrooms that are seismically safe. This also enables UPA to add up to 4 portables on the current Achieve campus as UPA is an important middle school option for our families.
